An In-Depth Explanation of the Fixed Establishment Concept – A VAT Workshop

Alexis Tsielepis continues his series of high-level VAT educational events with a workshop on the Fixed Establishment concept.

There is a lack of harmonised guidance concerning the definition of a Fixed Establishment. This important concept is being interpreted differently across Member States of the European Union, causing commercial uncertainty, as well as situations resulting in double or non-taxation.

The workshop will examine in depth the following areas of this complicated concept of the VAT legislation:

  • A review and analysis of the history of the Fixed Establishment concept through the European Court of Justice with an in depth explanation of each key decision
  • An analysis of the definition of a fixed establishment as this appears in the Implementing Regulation 282/2011
  • A review of how and where the concept appears in the VAT Directive
  • Practical examples of how the concept applies

Seats at the workshop are limited in order to foster one-on-one interaction and to provide an opportunity for participants to discuss and analyse their real-life examples.
